Commercial Litigation
We recognize that when a company faces a lawsuit irrespective of whether they are prosecuting or defending a claim, there is some other area of expertise which has made that company successful beyond the litigation itself. One of the goals of our commercial litigation practice is to know our clients' business and learn what makes them successful. Sometimes the advice we have to offer our corporate clients does not make us popular. We do not believe that it is our job to tell clients what they want to hear. Instead, we believe our value is to quickly and correctly assess the issues for them in an easily digestible way so that owners, principals, and c-level executives can make strategic decisions about the future of their businesses. Our commercial litigation practice group strives to provide a full range of services in resolving our clients' business disputes in the most cost-effective and proactive way.
Representative Experience
The following is a representative list of recent commercial litigation matters handled by the firm:
- Defense of Partnership in a suit by a real estate developer arising out of an alleged breach of contract to build an office building.
- Representation of a commercial developer and contractor sued by an HOA for damages exceeding $14 million. The HOA alleged that the rock retaining walls in the subdivision were poorly-constructed and needed to be torn down and rebuilt. After a 14-day trial, the firm not only prevailed with a verdict in favor of its clients, but was also successful in recovering a confidential settlement for its clients’ counterclaims after trial.
- Represented a purchaser of a business arising out of a failed acquisition of an existing business and was able to recover fees associated with due diligence efforts, brokers’ fees, and attorneys’ fees.
- Represented Panasonic North America in a dispute over a large volume of merchandise it sold and delivered to a substantial buyer. Obtained a favorable settlement after deposing the opponent’s key fact witnesses and corporate representatives.
- Successfully defended an oilwell servicing company involved in a dispute over services provided to a drilling company.
- Defended a steel pipe distributor, specializing in the sale of oilfield casing and tubing in a commercial dispute involving allegations of non conforming goods. Our client imported a large quantity of well casing and drill pipe from a Ukrainian company and had it delivered to the customer’s well site. After obtaining jurisdiction over a foreign company it was learned that the distributer of the pipe had substituted other products of an inferior quality and mislabeled them to appear to be conforming to the customer’s request. The distributor was eventually forced to pay all of the damages and suit was dismissed against our client for any and all claims.
